WORKERS’ COMPENSATION

Workers’ Compensation in Colorado is a “no fault” based system to provide benefits o workers injured on the job.  Employers are required by law to carry workers’ compensation insurance.  If you have been injured on the job or become ill, temporarily or permanently disabled, your benefits may include the following:  Payment of your reasonable, necessary medical care related to the on the job injury; Payment of your lost wages for the period of time the doctor takes you off work; Payment of prescription related to the injury; Payment for the mileage for travel for medical care; Disfigurement benefits for things such as scaring which are capped at $2,000.   Your employer must be notified immediately of an injury in writing.  If your employer denies your claim you have a right to a hearing to prove your injury was work related.  If you have missed more than three days of work because of your injury and have a doctor’s note, you may have a right to lost wages (temporary total disability) which pay 2/3ds of your average weekly wage.  Our firm charges a 20% contingency fee on the settlement for workers’ compensation claims.

SLIP AND FALL/PREMISES LIABILITY

People injured on someone else’s property may have a claim for money damages.  If you, a friend or relative were injured as a result of slipping on ice or some other liquid on a floor, sidewalk or parking lot which was due to someone else’s fault or negligence, you may have a claim to recover money for your medical bills and other out –of-pocket expenses, pain and suffering, physical impairment, scarring and inconvenience.  Premises liability claims can arise from many different types of situations such as a slippery floor at a restaurant, improperly constructed or maintained stairs, to insufficient or missing warning signs   Act NOW if you have been hurt the clock is ticking.  Take photographs of the incident scene as soon as possible to show the dangerous condition.  Take photos of any visible injuries such as bruises, cuts, casts etc.   There is a two year statute of limitations in Colorado for slip and fall claims.  This means you must either settle the claim or file a law suit within two years from the date of the incident or you will be forever barred from bringing the law suit to get money for your injuries and damages.  In some instances when a person slips, the place where the fall occurs may have insurance providing limited medical insurance usually between $1,000 and $5,000.

DOG BITES

Every year children and adults are bitten and disfigured by vicious dogs.  Our firm has represented numerous dog bite victims.  We work with experts both in plastic surgery and psychological counseling.  We know that injuries from dog bites leave both physical and emotional scars.  Even if this was the dog’s first bite, the owner or keeper is strictly liable unless the injured bite victim was a trespasser, teasing, or tormenting the dog.  If you or a loved one has been injured by a dog or other animal, you may have a right to money for payment of medical bills, pain and suffering, fear, scarring and emotional distress.

PERSONAL INJURY

Personal injury in general involves many types of situations and injuries.  It includes automobile accidents, dog bites, slip and fall and other injuries caused by the carelessness of another.  Three issued must be evaluated to determine your personal injury claim.  First, liability must be determined.  That is who caused the accident and is legally responsible for the injuries.  Second, an evaluation must be made to determine the amount of money you are entitled to.  And, finally, an investigation must be completed to determine where to collect the money damages from.  Often this will be an insurance company.  Perhaps the settlement will come from an automobile insurance company (maybe even yours) a homeowner’s insurance policy or a commercial policy of a business owner. WRONFUL DEATH

In Colorado wrongful death claims are controlled by statute.  The statute restricts who can make a claim for money as a result of a wrongful death.  You must be the surviving spouse, child or parent to bring a claim.  Brothers and sisters do not have a claim in wrongful death.  The claim must either be settled or a lawsuit filed within two years of the death or the claim will be lost forever.  Colorado has caps on the amount of money that can be recovered in a wrongful death case.  If you have lost a loved one, we are here to support you with compassion and dignity.  We will represent your interests against the person responsible and their insurance companies to obtain the maximum monetary recovery possible.

UNINSURED/UNDERINSURED MOTORIST

As most people are now aware, many drivers ignore the law and do not carry automobile insurance or carry insufficient insurance.  Colorado law requires that your insurance company to offer you uninsured motorists (UM) coverage to protect you from injury and damages caused by an individual with no, or insufficient insurance underinsured motorists (UIM).  You are required to have UM coverage unless you reject it in writing.  Since a large portion of the driving population is either uninsured or under insured, we recommend that all drivers have UM coverage.  UM coverage is a relatively inexpensive means to protect yourself from careless drivers causing you or your loved ones to be injured.  UM insurance can even protect you from Hit and Run drivers even if they don’t come in contact with your car.  Call Robert Paysinger to discuss the many complex legal issues involving uninsured or underinsured motorists.
